Article 1: Purpose

You are currently logged on the site www.idresstocode.com administered by the company Mode Operateur. These Terms and Conditions constitute a contract of distance selling and define the rights and obligations of the customer and the company Mode Operateur in connection with the sale of products offered by the website idresstocode. These general conditions of sale hereinafter "general conditions" or "contractual conditions" are concluded between, on the one hand, the company Mode Operateur, SARL au capital de 3500 €, registered at  French register of companies under the number 753 377 084, and  whose registered office is located at: Le Bas Fougeray, rue du Bas Fougeray 35500 Vitré, France, hereinafter referred to as "Mode Operateur" or the "Company" and, secondly, an individual hereinafter referred to as "Customer" or "you" who wants to make a purchase via the website "../>
The "double-click" you run after completing your order form is the validation of the sales contract and irrevocable acceptance of these terms when your order has been confirmed.



Article 2: Application

These conditions concern exclusively the non-commercial individuals. Similarly, they relate only to the conditions of sale by Mode Operateur on the website idresstocode, to the exclusion of any other method of distribution thereof. The relationship between Mode Operateur and the customer is governed exclusively by these Terms and Conditions, to the exclusion of any condition previously available on the site. Mode Operateur may have occasionally to modify some terms of these general conditions, so it is necessary that they are read each time you visit the site. These changes are effective after they are posted online and cannot apply to contracts concluded earlier. Each purchase made on the website is governed by the general conditions applicable at the date of the order. The general conditions are written in French. The English version is only for information purpose.



Article 3: Price

Prices are quoted in Euros (€), all taxes included. They include the costs of order processing, preparation, packaging. They do not include shipping costs that are paid by the customer unless otherwise stipulated clauses in the ordering process. The different shipping options (and their prices) are presented in the order process and specified in the summary of it.

The prices include the VAT applicable on the day of the order. Any change in the applicable rate will be reflected in the price of products.
The prices can be changed at any time by Mode Operateur, however prices cannot be changed once the Customer has confirmed his order.
The price of an item may be required to undergo price fluctuations due to business operations available on the site. The customer shall not be refunded in any case the amount of the difference if the customer has ordered an item that would experience a drop in prices, after placing the order on the site.
In case of obvious typographical error, leading to the display of a "wrong price", the sale may be canceled. If an error displays a wrong price of the article on some pages, only the price listed on the item description page is authentic.
Payment of the full price must be made to order products.
As for deliveries of products outside the French territory, the customs taxes and formalities are the sole responsibility of the Client, unless otherwise indicated. The Customer shall then check the possibility of importing the products ordered in the country of delivery.
For the countries of the European Union, prices are charged VAT included.
For countries outside the European Union, the prices are charged without VAT.


Article 4: Products

4.1 Description of products
The products offered by the site idresstocode are presented in French and English. The Customer may not assert his linguistic ignorance as a cancellation clause of the contract.
Mode Operateur provides the best possible descriptive text of the products.

4.2 Iconography
Pictures and illustrations on the website reflect the products sold. The colors are as shown in the descriptive text. Customer must refer to it as the colors of a picture may vary depending on the resolution and setting of each computer screen.

4.3 Products size
Sizes correspond to measurements that can vary from one manufacturer to another. Mode Operateur sets a link to an appropriate size table for each item that requires it. Customer should refer to the this table to choose the size.

4.4 Availability of products
Inventory items on the site are delivered in 4-10 days in France, depending on the mode of delivery chosen by the customer, the date of registration of the order, subject to possible error of our stock and subject to validation and verification of payment, subject to respect of delivery terms by our carriers. Our product offers are available within the limits of available stocks.

When an item is listed as unavailable on the site, the Customer may send an email to know when this product is back in stock by clicking on "notify me when this item is in stock."
Customer may also request a quote for a product not available in stock. He will soon receive an a date of availability and possibly a new price. Acceptance of the quotation stating the price and the new delivery date by the customer will be a valid command, after payment.
Some products or product categories, as customized products for example, can be provided "out of stock" and therefore have a longer delivery time than normal. In this case, the delivery time is given to the customert before the order, via a quote or mention in the descriptive data of the products.

4.5 Warranty
According to the French consumer code and the French civil code, the customer has a guarantee enabling him to return delivered defective products.
The product must be suitable for the purpose usually associated with such a product and correspond to the description given by the seller.

Article 5: Order

5.1 Capacity to contract
The customer certifies that the ability to purchase and pay on the site. Non emancipated minors and protected adults are not permitted to enter on a site selling online. Mode Operateur can request additional information from the customer in case of doubt.

5.2 Order process and contract conclusion

The customer can place an order 24 hours 24 7/7 via the website idresstocode.com

The customer wishing to validate an order must identify by filling in the appropriate provided form. The customer checks the content of the order and the total cost of it (ordered products, shipping options), corrects possible errors, confirms it and pays.
Mode Operateur accepts the order after payment verification and validation. This validation will value the contract.
The contractual information will be sent through a confirmation email to the customer subject to the condition that the customer indicates a valid email address.

5.3 Electronic signing and double click
According to the Law on electronic signature, any purchase order signed by the customer by "double click" constitutes an irrevocable acceptance of the purchase contract which cannot be challenged , except in limited cases provided for in this contract and by law . Any agreement on a quote emailed to the customer and returned to idresstocode with an explicit agreement, also constitutes an irrevocable acceptance.
The automatic registration order systems of the site are considered valid as evidence of the contract of sale and the date. Any order implies acceptance of the prices and descriptions of products available for sale.

5.4 Personal Information
When ordering, the Customer agrees to provide personal information to Mode Operateur. They must be valid so that Mode Operateur can treat correctly the customer's order.
The customer must verify all the information entered during the order (product (s) ordered (s), size (s), delivery address, billing address ...). If the customer after receiving the email confirmation of the order validation becomes aware of an error in his personal information, the customer must contact the Customer Service of Mode Operateur as soon as possible so that it is proceeded to rectification before the order is shipped. Mode Operateur cannot be held responsible for any errors entered by the customer or the consequences that this would cause in terms of delay or error in delivery. If delivery cannot take place due to a customer’s mistake, the re-dispatch cost will have to be paid again by the customer. In this case, the customer shall prohibit any claim if delivery times are not respected.

5.5 Refusal of an order by Mode Operateur
Mode Operateur reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order.
Mode Operateur reserves the right to refuse the order for a "cause" (as defined by law), including (but not limited to) in case of unavailability of the product, inability to perform the service, unfair request of the customer, the presumption of the customer’s inability to contract or a clear intention to harm the company.
The company reserves the right to refuse the order in the case of an obvious typographical error leading to the display of a "low price" at the time of the order placed by the customer.

5.6 Cancellation or change of control
The customer may at any time cancel or modify the order by contacting the Customer Service of idresstocode. If the customer's order has not been shipped, it avoids additional costs, such as shipping or return. (See withdrawal right in section 8.1)

 

5.7 Split order
Mode Operateur agrees to fulfill orders received in the order they arrive on site only within the limits of available stocks.
The order is despatched when it is complete. Mode Operateur reserves the sole right to split the order into multiple shipments of the customer at no additional cost.

5.8 Failure of delivery of the order
In the event of unavailability of one or more items from the customer's order, Mode Operateur will promptly notify the customer by an email or a post letter.
Mode Operateur will propose to either replace the product ordered by an equivalent product (quality and price), an extension of the delivery period, an asset, or cancel your order.
In case of cancellation if the order has been cashed, the customer will be refunded within 15 days maximum from the date on which the customer has been notified of the unavailability of the order.
If it is a partial unavailability of the order, Mode Operateur debits customer's bank account the sum total less the unavailable items.


Article 6: Payment

To set the order, the customer has the choice of payment methods referred to in the order process and presented on the site idresstocode. The customer warrants to Mode Operateur that has the necessary permissions to use the method of payment chosen by him during the validation of the order.

6.1 Payment by credit card
Idresstocode site uses secure payment solution for e-commerce Citelis developed by Crédit Mutuel ARKEA.
Payments by credit card are made by indicating your credit card number, the expiry date and the security code (3 digit code on the back of the card). Payment pages use SSL v3 encryption technology that secures all information you enter, by encrypting, and make them inaccessible to Mode Operateur or to potential fraudsters.
The payment solution is also PCI DSS certified by Visa and MasterCard to ensure the security and privacy of payment.
In the context of the fight against fraud, Mode Operateur has strengthened the safety of your online payments joining the program 3D SECURE developed by Visa and Mastercard.
An additional control may occur during your payment, a window opens and asks you to enter your 3D Secure. This allows you to authenticate and ensure that it is the holder of the said credit card who is making the payment.
There are different authentication methods depending on your bank; usually your bank sends a SMS indicating a code you must enter to confirm the transaction.

6.2 Invoice
An invoice will be edited when the order is validated. It will be automatically sent to the customer when ordering. It will be sent to the email address indicated by the customer in his order, unless otherwise indicated.

6.3 Checking and confirmation of payment
To reduce the risk of fraud, Mode Operateur may have to carry out checks on the validity of a payment.
In this case, the customer is notified by email of documents to send to Mode Operateur (via email or mail) in order to proceed to the final validation of the order.
Mode Operateur cannot be held liable in this case of the extension of the delivery period stipulated in these general conditions of sale.
At the end of this control Mode Operateur reserves the right to accept or cancel the Customer's order.


Article 7 : Delivery

7.1 Delivery
The delivery date of an order is updated each time you add an item in your cart. It is communicated in the customer’s shopping cart;

Any order placed on the website before 14 pm Monday through Friday (excluding holidays) will generally be prepared and shipped within two business days, subject to confirmation of payment and subject to the customer's order is completely on stock. The order will be executed within a period not exceeding seven days of the date of delivery specified in the order.
For deadlines for specific services (customization ...), please contact customer service or to request a quote on the site.
The delivery includes the time of validation and preparation of orders, plus the transport time.
In the case of a delay in delivery, please notify the company by contacting customer service.

7.2 Methods of Delivery for France


Home delivery by La Poste Colissimo
You are home delivered within 2 days (working days for shipments in mainland France, Corsica and Monaco). The parcel is deposited in your mailbox or given in hands without signature.
In case of non-delivery of your parcel (mailbox size...), your postman leaves a notice of passage mentioning the date and the address of the post office where you can collect your parcel upon presentation of an identity.
IMPORTANT:
You have 15 days to collect your parcel at the post office. After this period, it will be automatically returned to the sender.

Delivery to a Relay Point ®
Delivery to your pick-up point within 2 or 3 days. In France, 100% of consumers have a Relay Point ® in less than 10 minutes from home.

You choose the closest Relay Point ® to your home or your place of work in the ordering process. See the relays and their opening hours and follow your parcel in real time on the website idresstocode.com



7.3 International delivery

The countries we deliver to, are listed on the website at the delivery terms section; If of another country, please contact customer service.

Delivery to a Mondial Relay pick-up point in Belgium, Luxembourg, or a Puntopack in Spain.

Delivery to your pick-up point within 2 or 3 days.

Colissimo expert international

You are home delivered in 5 to 7 days. Delivery against signature.
If you are not there, your postman leaves a notice of passage mentioning the date and the address of the post office where you can collect your parcel upon presentation of an identity.
You will have then15 days to collect your parcel. After this period, it will be automatically returned to the sender.

Priority International Small Parcel
For parcels of low value, or for countries with parcel tracking, we can offer you the Priority International Small Parcel of La Poste.
In case of inaccessibility due to a too small mailbox, your postman leaves a notice of passage mentioning the date and the address of the post office where you can collect your parcel upon presentation of an identity.

7.4 Delivery Rates
The delivery rate is calculated based on the weight of your order, the delivery method chosen and the country of delivery. It is indicated on the order form before your confirmation.
For information, rates are available on the website in the delivery section.

7.5 Delivery incomplete or non-compliant (due to carrier)

It is possible that the parcel be damaged and the contents partially or totally stolen.
If you experience such an error, please mention it to the carrier and reject the product.
In case you realize the damage after the carrier's departure, please report it by email to serviceclient@idresstocode.com
within a maximum period of 72 hours following receipt of the order.
ou then have to send your justified protest by registered letter with acknowledgment of receipt to the carrier, this within three days (not including holidays).
For Colissimo, Colissimo International, Max Letter, Priority Small Package, please bring your parcel to your post office to settle your claim.


7.6 Delivery incomplete or non-compliant (because of the company)
Despite the care taken in preparing the orders, a product may be missing it, or an error have occurred during the preparation.
If you experience such an error, please report it as soon as possible and if possible within 72 hours following receipt of the order. This notification can be made by email to serviceclient@idresstocode.com

7.7 Parcels lost
In the event a parcel is lost by one of our carriers, please let us know as soon as possible.
Mode Operateur will conduct a survey. It can last several days (20 days on average). During this period, no refund or resend will be made.
Mode Operateur may need to ask you some documents and a sworn statement of non-receipt of the parcel.
The investigation by the Post Office or with Mondial Relay will allow Mode operateur to obtain the evidence necessary for the receipt or non-receipt of a package and to obtain evidence that a package is lost.
When the investigation is closed, Mode Operateur may decide to return identical items to those that had been ordered. No change order may be made, except if an item is no longer available, in which case the customer may choose another item. The customer will then pay the amount of the difference, if the item chosen instead is more expensive. In the opposite case, Mode Operateur will refund the difference to your credit card or in the form of a credit on account of your next order.

7.8 Not withdrawn Parcels
If the parcel is not collected in time at the post office or in the relay point, it is automatically returned to Mode Operateur. In this case, the customer will be asked to decide what he wants, refund or reshipment. Transportation costs will not be refunded. A new postage fee will have to be paid before reshipment.

Article 8: Satisfied or refunded

8.1 Right of withdrawal
In accordance with Article L121-16 and 121-20 of the French Consumer Code, the customer has a period of seven (7) days to use his right of withdrawal. This period starts from the date of receipt of the order by the customer.
For the return postage and return conditions, please refer to section 9.1 and 9.2
This right of withdrawal cannot be used for customized products.

8.2 Satisfied or refunded
To give you time to think, Mode Operateur adds seven (7) additional days to legal deadline to return products.
To facilitate the process of its return, the customer may contact the company by email to obtain a return number before forwarding. This condition causes no cancellation of the right of withdrawal.

Article 9: Returns and refunds

9.1 Conditions of Returns

Items must be returned in a perfect state, so that they can be sold again : complete, not worn except for trying on, not damaged, not washed, not ironed, with their label attached. Items such as panties, thongs, can be tried on, but for hygiene reasons, the customer must try them keeping his own underwear. Stockings and tights cannot be returned if tried on.
 

9.2 Costs of return
For France, when deliveries were made in Relay point, Mode Operator supports the cost of returning; for this you just need to contact customer service, and you will be send a label to print out and stick on your parcel; then you drop the parcel at the Relay point you choose and it is shipped to the company.
For other destinations, or when deliveries were made by La Poste (Colissimo, Colissimo international expert, Lettre Max, Priority International Parcel) returns are paid by the customer and under his responsibility in case of loss or damage. The return must be shipped using tracking parcel to the address: Mode Operator, Le Bas Fougeray 35500 Vitré France

 

9.2 Refund
If the conditions described in section 9.1 are met, the customer will be refunded the amount of returned items by crediting his bank card, or account credit if the customer so requests, within 15 days after receiving the return on our premises. The refund is only for the item(s) value, and do not include the initial shipment cost.

 

 

9.3 Exception

When the return of an order is to be made for Mode Operateur erred in preparing the customer's order, the customer has to contact the customer service to organize the return. Mode Operateur will send by email a label to be put on the parcel for resending at Mode Operateur’s cost.

Article 10: Property


Products remain the property of the company until the contract has not been executed entirely. Risk transfer takes effect upon the effective delivery of products ordered through the online store.
The documentation provided to the customer is governed by the French Code of Intellectual Property. It remains the property of the company. It is therefore forbidden to reproduce, sell, or exploit the provided documents without the consent of the company.

Article 11: Privacy

11.1 Data Protection
This website has been declared to the CNIL (Commission Nationale Informatique et Liberté) under the number 1617839 v 0; this commission regulates the data treatments in accordance with the customer data-prospects NS48 norm. It is available on the website of the CNIL (www.cnil.fr).

11.2 Collected Data

11.5 Fraud
Mode Operateur controls each order that has been validated. These controls are aimed to prevent from any fraud attempt.
Mode Operateur shall record your IP address, and the exact dates and times of the transaction.
Any fraud attempt, for any amount whatsoever, and regardless of origin, will be prosecuted. The completeness of data collected at the time of order will be sent to the Prosecutor for investigation.

Article 12 : Intellectual property

All elements of the site, technological and content (software, pictures, texts...) are the exclusive property of their authors and may not be reproduced or used without the consent of the latter.
The customer can make a backup of these general conditions of sale as well as other elements of the site that maybe useful as an archive of the transaction.

Any reproduction of partial or complete contents of the site is prohibited.
If you wish to establish a link with the site, please contact Mode Operateur beforehand.

Article 13: Force majeure

 Mode Operateur cannot be held responsible for the breach of contract due to the occurrence of an event of force majeure (as defined under the French Law) and in particular in case of total or partial strike of postal services, disasters caused by floods or fires. This limitation of liability also applies to the breach of the contract caused by the unforeseeable and insurmountable intrusion of a third part unconnected with the provision of the services.

Article 14 : Entire agreement

These terms represent all obligations of the parts.
No general or specific condition provided by the customer can be integrated with these terms, except in cases of prior agreement between the parts prior to the conclusion of the contract.
The fact that the company does not rely on a failure by the customer to any of the obligations contained herein cannot be interpreted in the future as a waiver of the obligation in question.

Article 15 : Applicable law


The site www.idresstocode.com is administered from our headquarters in France.
This contract is subject to French law. In case of dispute, the parties shall favor the out of court way.
This search for an out of court solution does exclude to act legal actions.
In the absence of settlement, the French courts will have exclusive jurisdiction.
